Telephone Consumer Protection Act Working Group

The Telephone Consumer Protection Act prohibits, with limited exceptions, telephone calls and text messages to cell phones using an autodialer unless the caller has the "prior express consent" of the "called party." This working group assists ABA with its efforts to reform the Federal Communications Commission's TCPA rules to facilitate communication between a bank and its customers. Members of the group provide information and other feedback on the TCPA's impact on their banks' ability to serve their customers, for use in ABA's advocacy before the FCC, courts, and Congress. The group also promotes awareness of TCPA litigation risk and provides a forum for peer discussion of TCPA compliance challenges and recent developments in the TCPA case law.
