Delaware Privacy of Consumer Financial and Health Information, Privacy and Opt Out Notices for Financial Information (18 Del. Admin. Code 904-2.0)

Requires financial institutions to provide clear initial and annual privacy notices outlining their data practices, subject to regulatory enforcement.

About the Legislation:

A licensee shall provide a clear and conspicuous initial privacy notice that accurately reflects its privacy policies and practices to customers and consumers (unless an exception applies). A licensee shall provide a clear and conspicuous notice to customers that accurately reflects its privacy policies and practices not less than annually during the continuation of the customer relationship. Annually means at least once in any period of twelve (12) consecutive months during which that relationship exists (unless an exception applies). The initial, annual, and revised privacy notices must include regulatorily required information. A licensee may satisfy the initial notice requirements for a consumer who is not a customer by providing a short-form initial notice at the same time as the licensee delivers an opt out notice.

Private Right of Action: No.
Damages/Enforcement: Subject to administrative enforcement by the Insurance Commissioner of Delaware.
