Delaware Fraud and Consumer Protection Division, Home Improvement Services

Prohibits deceptive practices in home improvement transactions, including misrepresentations and contract violations, with a private right of action and remedies such as injunctions and damages.

About the Legislation:

In a home improvement transaction, it is an unlawful practice for a person to fail to include required information in a home improvement contract; fail to abide with timing requirements related to a home improvement contract; fail to provide a buyer with a summary of these regulations; disclaim, exclude, modify, or attempt to limit any warranty or remedy provided by law; make certain representations to a buyer or prospective buyer; make certain misrepresentations; mislead a prospective buyer; or gain entry or access to a prospective buyer’s home or property under a false guise.

Private Right of Action: Yes (via 6 Del.C. §§ 2513(a) and 2525).
Damages/Enforcement: Restraining orders, injunctions, appointment of receiver and administration of estate, costs, damages.
