Mortgage Servicing: Continuing Compliance Challenges

Over the past several years, mortgage servicers have had to implement and adapt to new requirements imposed by the Bureau of Consumer Protection. To further complicate things, many states have also taken it upon themselves to enact laws regarding mortgage servicing practices.

Attorneys Jason Busby, Chris Hawkins and Jonathan Kolodziej from Bradley take a look back at some of the most challenging aspects of the federal mortgage servicing rules, including provisions related to successors in interest and servicing borrowers in bankruptcy. They highlight ongoing interpretation and compliance challenges banks and servicers continue to face even though the rules are now fully effective. They also provide an overview of some of the mortgage servicing-related state laws that have recently been put in place, and note areas where state law is more restrictive than the federal counterpart.
