ABA Applauds TCPA Court Decision

By Virginia O’Neill, senior vice president of ABA’s Center for Regulatory Compliance

“Today’s D.C. Circuit Court of Appeals decision is an important step toward allowing customers to receive information they need and want, in the way they want to receive it.  The ability for financial institutions to send time-critical, non-telemarketing communications to customers, including suspicious activity alerts and data security breach notifications quickly and efficiently with cell phone calls and text messages, is critically important and of value to consumers.

“With today’s decision, the Federal Communications Commission has a fresh opportunity to revisit its interpretations of TCPA to make sure that they meet the evolving communications needs of today’s consumers. We hope that today’s decision enables the FCC to pursue smart, modern policies that aggressively target scammers and illegal telemarketers while allowing companies to protect their customers.”
