ABA Issues Summary of DOJ's Evaluation of Corporate Compliance Programs

ABA on June 22 issued a staff analysis on the Department of Justice's updated guidance on the Evaluation of Corporate Compliance Programs. The guidance sets forth specific factors prosecutors should consider when conducting investigations, determining whether to bring charges, and negotiating plea agreements. The guidelines are meant to help federal prosecutors determine the overall effectiveness of a compliance program. While not specifically geared towards financial institutions, the guidelines offer a helpful roadmap for developing and maintaining compliance programs. For more information, contact Rob Rowe.
