The FCC is seeking comments on the ACA International's petition for an expedited clarification and declaratory ruling concerning the Telephone Consumer Protection Act rules. Specifically, that petition seeks clarification that the rule prohibiting the use of automatic telephone dialing systems to cell phones absent the consumer's express consent does not apply to predictive dialers used for debt collection purposes.

ABA Comments

ABA supported the petition, asking that the FCC clarify that predictive dialers are not "automatic telephone dialing systems" subject to the prohibition against calling cell phones absent the consumer's express consent. In any case, the FCC should exempt calls to cell phones of those with whom the caller has an established business relationship.
