A trustee with decanting power has the ability to amend an unamendable trust, in that the trustee may distribute the trust property to a second trust with terms that differ from those of the original trust. Numerous states have enacted statutes that allow trust decanting. It is a powerful tool, and one that can be subject to abuse by the trustee or counsel for trust beneficiaries who encourage its use. The presenters will review the current state of the law and discuss the difficult issues that can arise in trust decantings.
