Decanting Issues

A trustee with decanting power has the ability to amend an unamendable trust, in that the trustee may distribute the trust property to a second trust with terms that differ from those of the original trust. It is a powerful tool, and one that can be subject to abuse by the trustee or counsel for trust beneficiaries who encourage its use.
