Real Estate Settlement Procedures Act (RESPA) - Section 8 in Today's World

What Are Implications for Your Institution?

Wednesday, January 16, 2019 • 2:00 - 3:00 p.m. ET

1.25 CRCM, 1.25 CERP

Big changes in the mortgage finance markets means that Section 8 of RESPA—the law that regulates referral fees and payments among settlement service providers in residential real estate transactions—is again very relevant. In light of recent court decisions and other interpretations, it is important to focus on what the law allow and what it prohibits. Banks must stay compliant, but they also must meet the competitive pressures of realtor relationships, joint ventures and affiliated arrangements, among other things.

Our panel of experts will discuss RESPA Section 8's framework, how to stay compliant, and how to deal with the patchwork of interpretive authority that comes with it.

Discussion Highlights:

  • Examine the existing state of the law pertaining to anti-kickback and anti-referral fee provisions of RESPA
  • Review how the law has changed and where it likely will go in 2019 and beyond
  • Take a look at prior enforcement actions and consent orders, and provide lessons learned from these actions
